Welcome to Anchor SMS. By accessing or using our service, you agree to comply with and be bound by the following Terms and Conditions. Please review them carefully.

1. Acceptance of Terms

By using the Anchor SMS website and service, you signify your acceptance of these Terms and Conditions. If you do not agree to these terms, please do not use our service.

2. User Accounts

To access certain features of the service, you may be required to create an account. You agree to provide accurate and complete information during registration and to keep your account credentials confidential. You are responsible for all activities that occur under your account.

3. Use of the Service

You agree to use Anchor SMS for lawful purposes only and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the service. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within Anchor SMS.

Messaging compliance and sender responsibilities

You must obtain, record, and retain valid consent from all recipients prior to sending messages, comply with applicable carrier/industry rules (including but not limited to U.S. A2P 10DLC, CTIA best practices, and country-specific sender requirements), and honor opt-out keywords. You agree to:

Send only to contacts who have explicitly opted in to receive your messages.
Include clear identification of your business and a simple opt-out instruction in your first message to a recipient.
Honor opt-out keywords (e.g., "STOP") promptly; we will also process standard opt-out/HELP keywords where carrier rules apply.
Use an appropriate, compliant sender (e.g., registered 10DLC, local long code/short code, or pre-approved alphanumeric) per destination rules.

Acceptable use and prohibited content

You may not use the service to transmit illegal content or violate carrier policies. Prohibited or restricted categories include unsolicited spam, phishing or fraud, hate/harassment, promotion of illegal substances/activities, and content restricted by local law or carrier policy (including certain SHAFT categories without required approvals). We may suspend or terminate access for violations.

Data retention for messaging

For operability, troubleshooting, and compliance, we retain limited message metadata (e.g., to/from numbers, timestamps, delivery status, provider SIDs) for up to 12 months, and message content for up to 90 days by default. You may request shorter retention where permitted. Accounting/charge records may be retained longer to satisfy legal obligations.

Subprocessors and carriers

We use telecom providers and infrastructure vendors to deliver the service, including but not limited to Twilio and Infobip for messaging. Networks and carriers in recipient countries also process messages. See the Privacy Notice for details.

Service availability and changes

Delivery can be affected by carrier policies, recipient handset status, and regional restrictions. We may apply reasonable rate limits and make changes to features to maintain reliability or compliance.

4. User Content

Any content you provide or generate through the service is your responsibility. You agree not to upload or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

5. Intellectual Property

The content, features, and functionality of Anchor SMS are and will remain the exclusive property of Anchor SMS and its licensors. The service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Anchor SMS.

6. Disclaimers

Anchor SMS is provided on an "AS IS" and "AS AVAILABLE" basis. Anchor SMS makes no representations or warranties of any kind, express or implied, as to the operation of the service or the information, content, materials, or products included thereon. You expressly agree that your use of Anchor SMS is at your sole risk.

7. Limitation of Liability

In no event shall Anchor SMS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Indemnification

You agree to defend, indemnify and hold harmless Anchor SMS and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the service, by you or any person using your account; b) a breach of these Terms, or c) Content posted on the service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
